APA Appointed to P&C Fraud Taskforce for the Coalition Against Insurance Fraud

The APA has joined forces with the Coalition Against Insurer Fraud, a national organization dedicated to combating insurance fraud through outreach efforts, group advocacy and research.

While we believe that fraud happens on all sides, here at the APA we want fraud prosecuted equally on all sides.

After being appointed to the Board of Directors, the APA was appointed to the P&C Fraud Taskforce. Our perspective that insurance fraud is not just perpetrated against insurers, but also by the third-party vendors hired by insurance companies such as TPA’s and engineering firms.

Being made a part of the P&C Fraud Taskforce offers that insurance fraud is not just perpetrated against insurers, but is also commonly perpetrated by insurer hired third-party vendors. This year a new “Internal Fraud” initiative based on addressing these crimes will be pursued.

The Coalition’s mission statement is: “To unite members in a concerted effort to discuss, identify, and combat fraudulent activities within the property and casualty insurance sector, the task force will focus on collaborative efforts to address emerging fraud schemes, complex fraud, the importance of anti-fraud private and public partnerships, as well as fraud detection and crime prevention measures.”

We would like to thank the Coalition Against Insurance Fraud for openly embracing our organization and other consumer protection organizations who defend policyholder rights.

Doug Quinn and Heather Shapter attended the Coalition Against Insurance Fraud Mid-Year Meeting on behalf of the APA this past June, and they will be attending the CAIF Annual Meeting in Arlington, VA on December 2–3.

PROSECUTORS CORNER

An update from Dominic Dugo, the head of the APA CPU

The APA Consumer Protection Unit (CPU) continues the battle to protect consumers from insurer fraud. CPU thanks all APA members who have submitted fraud referrals to us. Each CPU team member is utilizing their over 30 years of law enforcement experience to work on your cases.

CPU was honored to present a class on insurer fraud during the APA Annual Conference in Nashville, Tennessee on October 17–18, 2024. Our prosecution strategy was shared with APA members. CPU carefully reviews referrals and conducts thorough investigations. Thereafter, if the facts support law enforcement opening a fraud investigation, CPU puts together a quality fraud referral package to submit to law enforcement.

Our goal is that when APA submits a fraud referral, law enforcement knows they should open a criminal investigation. This is a critical stage because, in states like Florida and others, there are thousands of fraud referrals submitted annually to law enforcement. Only a small fraction of the referrals submitted get investigated. Keep in mind that just because law enforcement opens a criminal investigation, it does not mean someone will be prosecuted. However, no one will be prosecuted if the criminal investigation is never opened.

CPU is proud to report that our criminal investigation strategy with law enforcement is working. Currently, major CPU fraud referrals submitted in Florida and Louisiana are being investigated by law enforcement. In addition, in California, CPU will be presenting on the topic of insurer fraud to the California Department of Insurance investigators working the wildfires in the Los Angeles area. APA’s presence and influence is being felt nationwide.

By working together with you, APA, CPU, law enforcement, and Departments of Insurance, we can make sure that homeowners who have suffered property damage are not revictimized and defrauded. While at times it seems the road to justice is far away, we believe that justice for defrauded homeowners is just around the corner.

A WORD FROM OUR EXECUTIVE DIRECTOR

Doug Quinn

Greetings, Fraud Fighters!

This has been a busy year so far & we’re expecting some exciting developments with hearings on insurance planned in Florida, Louisiana, and the US Senate. The APA is at the center of it all fielding regular requests to share information with the press, elected officials, and staffers.

Our appointment to the P&C Fraud Task Force for the Coalition Against Insurance Fraud (CAIF) has allowed us to help shape the national Fraud Fighting agenda to include consumer protection.

Some of you may know, but we were in the works of planning a Jersey Shore Annual Membership Summit. Unfortunately, due to adverse circumstances in the chosen location, we regret to inform you all that we will be postponing until further notice.

We will still be holding a Quarterly Conference Call, releasing newsletters, and attending multiple conferences this summer including Win The Storm and The Experience.

To stay informed, please make sure you are a part of the Members-Only Facebook page.

PROFESSIONAL & COMPANY MEMBERSHIPS

For our industry professionals, we have three different levels of memberships; however, the membership you choose is based on what you are looking to receive from your membership with us.

Both our Professional and Company Memberships are available to industry professionals whether you are a restoration contractor, public adjuster, engineer, attorney, roofer, etc. These memberships include and access to our Membership Portal, APA exclusive platforms included but not limited to our APA Engineer Report and Evaluation Program (AREEP), access to our APA Members-Only hidden Facebook group, an invite to our annual APA Summit, special training in detecting & reporting insurer fraud, and the opportunity to utilize our logos and disclaimers. The difference between our Professional and Company Membership is that our Professional Membership is a personal membership just for you. You will be the only one to receive the APA benefits.

On the other hand, our Company Membership welcomes two APA Member contacts with access to the portal, Members-Only Facebook and APA Swag. Similarly, everyone in the company can position themselves as APA representatives meaning everyone can use our logos and disclaimers.

BOARD ADVISOR

Our Board Advisor Membership is an exclusive membership for Professional and Company Members who have been a part of the APA for at least one year and must be approved by our Board of Directors.

Board Advisors are the first members to be in-the-know and have the largest say in APA decisions.

FRAUD FIGHTING TIP OF THE SEASON

WHERE SHOULD YOU FILE A COMPLAINT?

GO RIGHT TO THE EXECUTIVE SUITE
It is easier to start at the top of the totem pole rather than having to work your way up. Some carriers refer to this as a “Presidential Complaint,” and lower-level employees are required to respond to the executive suite & justify their actions. Claims managers tend to be more fair when they know there is outside scrutiny on a case.

WANT TO STAY IN THE KNOW
